You know what’s a huge business these days? Prostitution. It makes about $186 Billion all over the world. That’s just the legal stuff. The illegal stuff makes another $40 Billion. Germany has the most hookers in Europe and they serve around 1.2 Million guys every day.

So you might wonder, is prostitution legal in Germany?

Well, yeah, it is. The German government lets people sell sex and even taxes them for it. The US might be famous for its sex industry but Germany makes a whopping 15 billion Euros every year from it. That’s like $18 Billion in US dollars. Germany has 400,000 hookers working every day. That’s more than any other country in Europe per person.

Prostitution has always been a thing in Germany. You can see hookers everywhere on the streets. The German government has always tried to keep an eye on this business. Before 1927, prostitution was illegal in Germany because there was no law about it. Then they passed a law in 1927 that made prostitution legal, the law was called the Law for Combating Venereal Diseases. They gave more rights to the hookers with another law called Prostitution Act in 2002. The idea was to give them social security and health insurance and benefits. The law also wanted to make their lives better by giving them legal rights to work contracts and have security and fair pay.

 

An aid organization has called for a ban on prostitution in Germany, saying that the country had become "Europe's brothel" due to lax laws governing sex work. It also asked for greater protections for sex workers ahead of the World Day Against Trafficking in Persons.

In a recent Morning Star article proposing the Nordic Model, they are canvassing for people to attend the Unison conference. Unison has long supported the discredited Nordic model. Up for debate is to change this stance to support decriminalization as practiced in New Zealand. The lie which the Nordic Model Now is that Germany is a decriminalized country for sex work.  This is not true; sex work is controlled in Germany by law. Escorts have to register.  They also discredit the decriminalisation as practiced in New Zealand.  All the evidence is this has been a success. Even so NZ is not totally decriminalised, foreign visitors are not protected by the law.

There is only one country which decriminalises sex work, and that is New Zealand. In Australia certain states decriminalise sex work, and this is growing. One other country, Belgium is decriminalising sex work, and that is Belgium.

As Belgium is also removing sex work from its penal code, the country is now the first in Europe, and the second in the world, to officially decriminalise sex work.

Decriminalisation will be happening step by step. Firstly, self-employed sex workers will be able to do their job legally, and stricter action will be taken against the abuse of prostitution. Additionally, advertising for prostitution will be allowed, but only when someone advertises their own sexual services.

The next step will be regulating sex work for employees by imposing rules regarding safety, hygiene, and working conditions on companies.

Social media posts by a German sex work network offering help to Ukranian sex workers have sparked a number of accusations on social media. These accusations say the group, Trans*Sexworks, are recruiting Ukrainians to work in German's brothel. This is blatantly untrue.  They state the group provides mutual aid to existing sex workers. Not a single member of the group works in brothels. The group was supporting people who already are sex workers. 

New research from Berlin throws light on sex workers funding their education. A totla of 4,386 students were enrolled into the study. 227 of these identified as sex workers. Most of the sexworkers  in the group worked less than five hours a week. Among those working, 5.7% reported violence whilst working. This was probably because 43% were potected by someone else whilst they worked.

Law makesr say the laws protect vulnerable people. Sex workers say the law is discriminatory, stigmatizing and has increased risks. Over 90% of sex workers in Germany break the law by not being registered. Sex workers don't want to register, because they have to provide provate dat, such as address and their real name. People do not register because they have concerns this coul affect their future job prospects.

The law was meant ro protect sex workers from human trafficking, but sex workers say it has made them more vulnerable.

SANS is working towards getting sexworkers the same human rights as the rest of society, and not be subjected to discrimination, oppression or stigmatisation. SANS counteracts the stereotypical and bias image that exists about the sale of sexual services.

We want a more sensible policy and legislation concerning the selling and buying of sexual services, a decriminalisation that means that the legislation surrounding sex for pay between consenting adults is removed. As a result of a policy change, sexworkers could then start to be protected for real by the existing laws, for example rape, sexual abuse, eg. trafficking

We are not working for the customers should have a right to buy sexual services, there is no such right, and one shouldn’t exist. It’s always the seller that has the right to refuse a business transaction, which he/she can do at any time without having to give a reason or explanation.

The network consists of a mixed group of members, but you do not have to be a sexworker or a client, or personally defend prostitution in a society to become a member.

What is important is that you want all human beings to have human rights and that you stand up for a more humane and pragmatic policy towards the sale of sexual services.

Born out of a frustration with the power imbalance between sex workers, managers, and owners, as well as a “common desire to see things done differently”, BSC are on a mission to overhaul the sex industry. As well as fighting for better working conditions and more autonomy over their work, the political and creative group are demanding an end to the wider criminalisation and stigmatisation of sex work.  They have produced a short film which appears on youtube.

Official figures show that the number of people registered as sex workers with German authorities declined sharply last year as coronavirus restrictions shut brothels for months.

At the end of last year, 24,940 prostitutes were officially registered with authorities, the Federal Statistical Office said. That was down from some 40,400 a year earlier — a 38% drop.

By some past estimates, more than two-thirds of sex workers aren’t registered. The statistics office noted that it is unable to give information on unregistered sex workers and brothels.

The number of officially sanctioned establishments offering sex services — the vast majority of them brothels or the like — stood at 2,290 at the end of last year, a 5% rise from the 2,170 registered a year earlier.

A regional court has struck down a ban on the operation of brothels in one of Germany’s states, arguing that the improving Covid-19 situation allows for sex workers to return to work.

The High Administrative Court of Baden-Wurttemberg ruled that brothels can once again open their doors on Monday following a request filed by a brothel operator from the Karlsruhe region. 

The country’s sex workers’ union, the Professional Association of Erotic and Sexual Service Providers (BesD), welcomed the decision. “The fact that lawsuits always have to be filed in the first place is a tragedy and shows how little our industry is viewed objectively,” the group wrote on Twitter. Sex workers held several protests during Germany’s lockdowns, demanding that they be allowed to return to work.

The Bienenstock Eros Centre brothel in Heidelberg, southwestern Germany, opened its doors as a test centre after their facility was forced to close due to lockdown restrictions. 

Now, over 25 prostitutes have been specially trained and are conducting free Covid-19 tests for the locals.

With shops, restaurants and bars all open again in Germany, where prostitution is legal, sex workers say they are being singled out and deprived of their livelihoods despite not posing a greater health risk.

Several dozen prostitutes armed with an inflatable sex doll staged a protest in Berlin on Friday against coronavirus restrictions they say are preventing them from making a living.

The protesters gathered outside the Bundesrat upper house of parliament with red umbrellas and placards bearing slogans such as "Let us work," "Open the brothels now" and "Our sector is being driven underground".

Prostitution is legal and regulated in Germany, with sex workers entitled to employment contracts and social security benefits.

Brothels have been allowed to reopen in neighbouring countries such as Switzerland, Belgium, Austria, the Czech Republic and the Netherlands, the association pointed out.

Prominent German politicians on Tuesday called for brothels to be closed indefinitely, extending their temporary closure due to coronavirus restrictions.

Sixteen lawmakers from Chancellor Angela Merkel’s centre-right CDU party and the centre-left Social Democrats wrote a letter, seen by German media, to the premiers of the 16 German states warning that sex workers could become "super spreaders" of the virus.

The letter calls for Germany to take the opportunity to adopt the "Nordic model," under which paying for sex is illegal but selling sex is not. Under this model, sex workers are offered help and services to leave the sex industry and offered education, for example, language courses. In Germany, many sex workers come from eastern Europe.

GENEVA, 8 April 2020—The COVID-19 pandemic, as with other health crises, exposes existing inequalities and disproportionately affects people already criminalized, marginalized and living in financially precarious situations, often outside social protection mechanisms.

During these difficult times, the Global Network of Sex Work Projects (NSWP) and UNAIDS wish to draw attention to the particular hardships and concerns facing sex workers globally, and are calling on countries to ensure the respect, protection and fulfilment of sex workers’ human rights. 

UNAIDS calls on countries to take immediate, critical action, grounded in human rights principles, to protect the health and rights of sex workers. Measures should include:

  • Access to national social protection schemes for sex workers, including income support schemes.
  • An immediate firewall between health services and immigration authorities in order to ensure that migrant sex workers can access health services.
  • Emergency financial support for sex workers facing destitution, particularly migrants who are unable to access residency-based financial support.
  • An immediate end to evictions and access to appropriate emergency housing for homeless sex workers.
  • Stopping raids on sex workers’ homes and sex work premises and ensuring that all measures to protect public health are proportionate.
  • An immediate halt to arrests and prosecutions for sex work-related activity, moving away from punitive measures and criminalization towards reaching and serving those most in need.
  • An immediate end to the use of criminal law to enforce COVID-19-related restrictions, including forced COVID-19 testing and related prosecutions.
  • Automatic extensions on visas due to expire as travel restrictions tighten. Immigration detention systems must support detainees in safe accommodation.
  • The engagement of sex worker communities in responses—the meaningful involvement of sex worker-led organizations in emergency public health planning groups.

UNAIDS, as ever, stands ready to support countries in the implementation of the above recommendations.

Some German brothels closed with hardly any warning. Sex workers who had been fully employed suddenly feared homelessness. Many sought ways to keep working, at home or on the streets.

As essential as the government bailout will be for many, Bleier Wilp said about 80% of the sex workers are foreigners only temporarily in Germany — and are unlikely to see any rescue funds.

While some brothels forced to close sent their sex workers packing, others such as the Leierkasten in Munich decided to allow those unable to travel home because of the closings of many borders in the European Union to reside in the brothel. A few weeks ago there were 700 clients each weekend coming to the famous 40-year-old brothel as patrons of the women working its 45 rooms.
